Westchester County District Attorney Janet DiFiore announced that Patrick Colon, 21, of 315 Oxford Road, New Rochelle, New York, was charged today by Felony Complaint with one count of Promoting a Sexual Performance by a Child, a class “D” Felony, one count of Possessing an Obscene Sexual Performance by a Child, a class “E” Felony, for possessing and file-sharing illegal and obscene performances of sexual conduct by children less than sixteen and seventeen years of age.
On February 7, 2011, an undercover investigator from the Westchester County District Attorney’s Office was able to view a digital image of a sexual performance of a child less than seventeen years of age that was available for download by other people from the defendant’s computer.
The District Attorney’s Office began its investigation.
A search warrant was executed today at the defendant’s home address (March 22, 2011) during which time the defendant showed investigators digital files of a child who is less than sixteen years of age in an obscene sexual performance.
The defendant, who is employed as an Information Specialist with NYC Inc., was arraigned in New Rochelle City Court. Bail was set at $2,500 which has been posted.
His next court date is March 24, 2011.
The maximum sentence on the charges is 7 years in state prison.
Chief of the High Technology Crime Bureau, Michael Delohery, is prosecuting the case.
