Timothy O’Connor of Newsday writes how Samuel Cruz’s family plans lawsuit against New Rochelle police in fatal shooting
The family of Samuel Cruz on Wednesday intends to file a notice of claim — a prelude to a civil rights suit — against the City of New Rochelle and its police department over the May 26 shooting death of the mentally ill man, said an attorney retained by Cruz’s widow, Elsa.
The family has hired the same lawyers who filed a federal lawsuit against the City of White Plains on behalf of Kenneth Chamberlain Sr.’s family. Chamberlain, a 68-year-old emotionally disturbed man, was shot dead in November 2011 by White Plains police.
