NEW ROCHELLE, NY — The “Meaghan’s Law” web page for convicted child rapist Jose Martinez maintained by the New York State Department of Criminal Justice Services (DCJS) has been updated with new addresses after notification was provided to law enforcement agencies by Talk of the Sound that the information contained on the page was inaccurate.

Despite what appear to be flagrant probation violations, Martinez has yet to be re-arrested with multiple agencies passing the buck.

Last June, Talk of the Sound reported that Jose Martinez did not appear to reside at the address listed for him on the DCJS web site nor work at the employment addresses listed for him on the web site.

Last month, Talk of the Sound reported locating Jose Martinez living at a different address in Brooklyn and working at a different business in Manhattan. That information was provided to the DCJS and the New York Police Department Sex Offender Unit by Talk of the Sound.

While the terms of probation for a particular individual are confidential, under New York State law, a sex offender must register a new address with the DCJS within 10 days. That information is then updated on the DCJS web site within 1-2 days.

Further, it is almost always the case that a sex offender whose crimes occurred at a school would be prohibited from living near a school.

Martinez appears to have failed to make notification of his change of address at all and moved to an apartment within 1-2 blocks of multiple schools including two elementary schools, a middle school and a high school.

Westchester County Probation Assistant Commissioner Ed Barella previously told Talk of the Sound that Martinez’ terms of probation were confidential and would only say that Martinez had been transferred to Brooklyn and was no longer the responsibility of the Westchester County Probation Department.

According to the Brooklyn District Attorney’s Office and the New York State Department of Criminal Justice Services, this does not seem to be the case.

The Supervising Agency for Martinez on the DCJS web site is listed as Westchester County Probation.

Helen Peterson, spokesperson for Brooklyn District Attorney Kenneth Thompson, told Talk of the Sound “This is not a Brooklyn case. This is a Westchester case”.

Neither the Westchester County District Attorney’s office or the Westchester County Probation responded to requests for an explanation.

One knowledgeable source, familiar with the inner workings of probation departments in New York State tells Talk of the Sound that in 90% of the cases where the offender was associated with a school, a condition of their probation is that they not live within a certain proximity to schools. This same source, said that it sounded like Martinez was a “courtesy transfer” where Westchester County Probation still had the case but requested that Brooklyn monitor Martinez for them.

If true, the failure to violation Martinez rests with Westchester County Probation.

Westchester County Probation Assistant Commissioner Ed Barella did not return multiple voice messages left at his office number seeking further clarification as to whether Brooklyn had the Martinez case as a “courtesy transfer”.

Meanwhile, the lawsuit involving the City School District of New Rochelle and the victim in the Jose Martinez case continues. Judge Alan D. Scheinkman, Administrative Judge for the New York State Supreme Court in White Plains, NY has yet to respond to a August 25th, 2014 request for Talk of the Sound to cover the case and be granted access to the records in this case.
