NEW ROCHELLE, NY — Aisar Valiente, 39, has been charged with Course of Sexual Conduct Against a Child in the First Degree, a Class B Violent Felony. If convicted, Valiente faces 5 to 25 years in prison.
Valiente was arrested on November 20th and is being held at the Westchester County Jail on $500,000 bail. He appeared in New Rochelle City Court on Monday.
Valiente was charged with a course of sexual conduct dating back three years although police records indicate that the conduct went back to 2010 when the victim was 7 years old. She is 12 years old today.
A person is guilty of course of sexual conduct against a child in the first degree when, over a period of time not less than three months in duration he or she, being eighteen years old or more, engages in two or more acts of sexual conduct, which include at least one act of sexual intercourse, oral sexual conduct, anal sexual conduct or aggravated sexual contact, with a child less than thirteen years old.
The arrest came about as a result of an investigation initiated by Child Protective Services based on complaints by the victim that a person residing in the same apartment building had been touching her inappropriately for several years.
Valiente is a Guatemalan citizen with no social security number, according to police records.
In June, Humberto Agustin, also an illegal immigrant from Guatemala, was arrested and charged with Course of Sexual Conduct Against a Child in the First Degree.
