NEW ROCHELLE, NY — Aisar Valiente, 39, plead guilty Tuesday to one count of Course of Sexual Conduct Against a Child in the Second Degree, a class D felony. A Class D Violent Felony carries a 2-7 year maximum sentence.
Valiente was arrested by New Rochelle police on November 20th and charged last November with Course of Sexual Conduct Against a Child in the First Degree, a Class B Violent Felony which carries a sentence of 5 to 25 years in prison. he was held on $500,000 bail.
Valiente was charged with a course of sexual conduct dating back three years although police records indicate that the conduct went back to 2010 when the victim was 7 years old. She is 12 years old today.
A person is guilty of course of sexual conduct against a child in the second degree when, over a period of time not less than three months he or she engages in two or more acts of sexual conduct with a child less than eleven years old; or he or she, being eighteen years old or more, engages in two or more acts of sexual conduct with a child less than thirteen years old.
The arrest came about as a result of an investigation initiated by Child Protective Services based on complaints by the victim that a person residing in the same apartment building had been touching her inappropriately for several years.
Valiente is a Guatemalan citizen with no social security number.

In June 2015, Humberto Agustin, also an illegal immigrant from Guatemala, was arrested and charged with Course of Sexual Conduct Against a Child in the First Degree.
