NEW ROCHELLE, NY — Louis Apicella, 45, a former employee of the New Rochelle Board of Education, was back in New Rochelle City Court on Tuesday.
Appearing before Judge Eileen Songer McCarthy, Apicella was charged with two counts of harassment by the Westchester County District Attorney’s Office following an incident involving this reporter.
Apicella was arrested on Monday by New Rochelle Police after he repeatedly harassed this reporter before and after Apicella’s arraignment in New Rochelle City Court on January 19, 2022. He was charged Tuesday with Harassment—1st, a B Misdemeanor, and Harassment—2nd, a violation.
Apicella was previously arrested November 19, 2021, by the New Rochelle Police and charged with Disorderly Conduct and Petit Larceny at the Costco in New Rochelle. He reportedly stole steaks from the Costco butcher.
Prior to his arraignment on the Costco steak charges, Apicella first confronted Cox in the criminal courtroom of the New Rochelle City Court. Then, as Cox left the courtroom after the arraignment, Apicella came up behind Cox and closely followed him down a hallway, down a staircase, and out the front doors of the courthouse. Moments later, as Cox walked along the sidewalk, down North Avenue, near the Lockwood Avenue intersection, Apicella, drove past and made several threats before driving off.
CCTV video gathered during an investigation by the New Rochelle Police, and played for Cox, shows Apicella continued on North Avenue then made an abrupt U-turn before making a sharp right turn onto Garden Street. Apicella attempted to strike Cox with his vehicle, missing Cox by about a foot, before driving off.
In a statement to police, Apicella corroborated the series of incidents — much of it captured on CCTV video — but said, “he (Cox) started it” in the courtroom. Apicella denied attempting to strike Cox with his vehicle, saying words to the effect of “if I wanted to hit him, I would have”.
Apicella is due back in court on February 16, on both the Costco steak charges and the harassment charges.
Apicella is being represented in both matters by a public defender.

Louis Apicella, age 42, of New Rochelle, NY was arrested May 30, 2018, by the New York State Police and charged with Criminal possession of marihuana in the fifth degree, a Class B Misdemeanor, Criminal Possession of a Controlled Substance in the Seventh Degree, a Class A misdemeanor and a Violation for not wearing a seat belt.
