Mount Vernon man was assaulted by New Rochelle police officer Michael Vaccaro who was fired by NRPD in September.
NEW ROCHELLE, NY (April 17, 2024) — The New Rochelle City Council approved a Resolution last night to settle a Federal lawsuit brought by the Mount Vernon assaulted by New Rochelle Police Detective Michael Vaccaro in February 15, 2022.
Fogg will be paid $55,000.
Malik Fogg filed a Civil Rights Lawsuit in the White Plains Courthouse of the U.S. District Court for the Southern District on May 14, 2022, against The City of New Rochelle, New Rochelle Police Department, Joseph Schaller, Michael Vaccaro, Matthew Velasco, Scott Wallach and Melvin Molina.
The settlement applies to the City of New Rochelle, Scott Wallach, Matthew Velasco and Joseph Schaller. Melvin Molina and Michael Vaccaro are not included in the settlement. We are researching why.
UPDATE 4/24/2024: We reached out to Joseph Pecorino of the Office of the District Executive of the United States District Court
of the Southern District of New York.
“The Court was advised on April 10, 2024 that all claims between all parties have been settled, this the case was dismissed,” said Pecorino. “Settlements are confidential, between the parties. The Court has no knowledge of any stipulations between plaintiff and defendants Molina and Vaccaro.
Vaccaro was terminated by the New Rochelle Police Department in September 2023. In December 2023, Vaccaro filed an Article 78 seeking to be restored to his position with NRPD.
