New Rochelle Board of Education Will Resist Federal Immigration Law Enforcement by ICE

NEW ROCHELLE, NY (February 4, 2025) — The New Rochelle Board of Education will discuss a resolution at tonight’s meeting on its plans to defy U.S. Immigration Law.

The discussion item on Immigrant Student Rights comes as many parents are keeping their children home from school.

The resolution seeks to “reassure the immigrant community” because “students and families have expressed fear and confusion about the continued physical and emotional safety of all students as well as the right to access a free and appropriate public education.”

The resolution continues, “the BOE recognizes the potential for U.S. Immigration and Customs Enforcement (“ICE”) officials to conduct enforcement efforts to detain undocumented individuals, and that such efforts may result in ICE officials seeking to enter upon school grounds for purposes of enforcement.

The resolution is intended to counter U.S. immigration policy under the Trump Administration. Last week, the Department of Homeland Security reversed longtime policies restricting Immigration and Customs Enforcement and Customs and Border Protection arrests in certain locations, including churches, schools, and hospitals.

CSDNR does not consent to granting non-local law enforcement agencies, including the U.S. Immigration and Customs Enforcement (ICE), access to school facilities, students, or student records for immigration enforcement purposes absent confirmation from CSDR legal counsel that there exist exigent circumstances, a judicial warrant, a court order, or validly issued subpoena; and be it further… CSDNR personnel shall not inquire about or record a student’s or a family member’s immigration status and shall not disclose any student record information including without limitation, the immigration status of any student or other personally identifiable information except in accordance with applicable law.

Superintendent of Schools Dr. Corey Reynolds will provide guidance to faculty and staff “should the circumstance arise when any immigration law enforcement agent or officer appears at a school site”.
