Bronx Man Nabbed for Drunk Driving with Toddler in Car

MAMARONECK, NY (April 22, 2025) — A Bronx man faces felony charges after state troopers arrested him for driving intoxicated with a 1-year-old child in his vehicle on Interstate 95 in Mamaroneck, authorities said.

Marvin X. Gallardo, 33, was stopped by New Rochelle State Police at approximately 1:58 a.m. on April 21, 2025, while driving a 2018 Mercedes-Benz southbound on I-95. Troopers pulled him over for multiple traffic violations and observed signs of intoxication during the interview, according to a police report.

Gallardo failed standardized field sobriety tests and was taken into custody. A breath test at the New Rochelle State Police station revealed a blood alcohol content of 0.14%, nearly twice the legal limit, police said. A 1-year-old child was found in the vehicle at the time of the stop.

Further investigation uncovered a prior DWI conviction for Gallardo in 2017. He now faces charges including Aggravated Driving While Intoxicated with a Child Passenger under Leandra’s Law, an E felony, as well as Driving While Intoxicated with a Prior Conviction and Driving While Intoxicated Per Se with a Prior Conviction, both E felonies. Gallardo also faces multiple vehicle and traffic violations.

Gallardo was issued an appearance ticket and is scheduled to appear in Mamaroneck Village Court on May 15, 2025.

The arrest highlights the enforcement of Leandra’s Law, which imposes felony charges for driving intoxicated with a child under 16 in the vehicle. Authorities urge drivers to avoid impaired driving to ensure public safety.
