Robert P. Rubicco: Criminal, Liar, Fraud, Daycare Operator: Table of Contents
NEW ROCHELLE , NY (December 9, 2025) — Anna & Jacks Treehouse, a New York child care center with License/Registration ID 753272, has been issued 55 violations by the New York State Office of Children and Family Services since receiving its license on July 5, 2016. These include here are 7 incidents that directly involve child abuse or endangerment, violations explicitly related to Child abuse or maltreatment, inadequate supervision that leaves children without competent oversight, posing an endangerment risk and failure to conduct background checks, which could allow unfit individuals access to children.
The center’s website states the business operated from 2013 to 2016, but OCFS records indicate it was first licensed in 2016 so there are no records of inspections and violations from 2013 to 2016. During this period, Rubicco operated an unlicensed daycare center in his home. He has publicly stated there were 12 children in the first year, requiring an OCFS license. In New York State, operating an unlicensed child day care center for 12 or more children at one time — even for less than three hours per day — is a crime punishable by up to one year in jail as a Class A misdemeanor under Social Services Law § 390, escalating to a Class E felony with up to four years in prison if the operator continues after being ordered to obtain a license.
During this period Rubicco was serving the remainder of his sentence of three years on probation for impersonating an assistant district attorney in a state witness tampering case, was on probation in a federal computer hacking case, sentenced to home confinement then later to wearing an ankle monitor, absconding out of state, abusing cocaine and alcohol, forging records and manipulating his drug testing, and serving time in federal prison.
Records obtained from the OCFS database in 2022 excluded information on fines or corrective action plans, which the OCFS website states can be obtained by contacting the regional office. Repeated calls and emails to OCFS yielded false promises and stonewalling, and a referral to then-Gov. Andrew Cuomo’s office received no response.
The violations include 13 fire safety issues, three of which remain marked as “Not Corrected” in the OCFS database. The total includes two major violations pertaining to child abuse and one pertaining to background checks. As of the last inspection on Oct. 27, 2025, the facility has uncorrected violations.
