NEW ROCHELLE, NY — This article is Part VII in an Investigative Series by Talk of the Sound into apparent violations of the Americans with Disabilities Act at New Rochelle schools. Overall Grade: C

Davis Elementary School has three parking lots, one in the back of the school and two in the front, one near the playground and one near the tennis courts. There is also several new Accessible Parking Spaces directly in front of the school in the traffic circle.

Davis/Back Parking Lot (near baseball field)

There are 19 parking spaces, 0 Accessible Parking Spaces, and 0 Van-Accessible Parking Spaces.

Davis/Front Parking Lot (near playground)

There are 24 parking spaces, 1 Accessible Parking Space, and 0 Van-Accessible Parking Spaces. The Accessible Parking Space has proper signage but no Access Aisle.

There are 11 parking spaces, 1 Accessible Parking Space, and 0 Van-Accessible Parking Spaces. The Accessible Parking Space has proper signage but no Access Aisle.

While these are the nicest looking Accessible Parking Spaces in the District they are not compliant. The are signed. They have Access Aisles. There are two Access Aisles interspersed between three Accessible Parking Spaces which are 85 inches and 82 inches respectively. Both are wider than than the 60 inches required for Car Access Aisles but both are also well below the 96 inches required for Van Access Aisles.

ADA Davis 1404

Davis Elementary School has 8 Curb Ramps. None of them are complaint because the Slope of the Flared Sides are too steep — ranging from 8.5 degrees to 13.1 degrees, well above the maximum of 8.33 degrees for the Slope of Flared Sides of Curb Ramps. In addition, half of them have Transitions that are not Flush.

There are no exterior Access Ramps at Davis.

Talk of the Sound offered to meet with the District’s ADA/504 Coordinator to review these things in advance of publication. That offer was declined.
