NEW ROCHELLE, NY — Charges against Daniel Houghton, aged 38, of New Rochelle were today upgraded to Attempted Murder — 2nd by the Westchester County District Attorney’s Office. He is now facing a minimum of 10 years in prison with a maximum of 25 years.
New Rochelle Police arrested Houghton in Mount Vernon yesterday afternoon following a shooting in a second floor apartment at 92 Horton Avenue shortly before noon.
According to the Westchester County Assistant District Attorney Beth Gordon, Houghton lived in the apartment with his mother and stepfather.
As Houghton pointed a gun at his stepfather and pulled the trigger, the victim raised his arms for self-protection, Gordon said. Houghton shot him in the forearm. The victim was transported to Jacobi Medical Center in the Bronx and treated for a non-life-threatening injuries.
In a bail hearing today before Judge Jared R. Rice, the ADA Gordon said Houghton is a predicate felon. He was previously arrested in 2009 on a violent felony charge which was not described beyond that the charge involve the same victim.
Legal Aid attorney Courtney McGowan, representing Houghton, said he attended New Rochelle High School, earned his GED, and worked for more than five years as a dishwasher, most recently at Piper’s Kilt in Eastchester, NY. Before that, he worked as a taxi driver.
In arguing that Houghton was a flight risk, ADA Gordon noted that after the shooting in New Rochelle he fled to Mount Vernon and that when police attempted to take him into custody at an apartment in Mount Vernon, Houghton fled again, this time out a window into a fire escape where he was unable to get down.
Judge Rice set bail at $100,000 cash, $250,000 bond and $250,000 partial bond and issued Temporary Orders of Protection for Houghton’s mother and stepfather.
Judge Rice set a date of June 22 at 9:30 a.m. for a felony hearing.

Well it’s about time that this rogue cop got charged for excessive force. He should have been arrested, charged, prosecuted, and convicted for assaulting that defenseless man. I hope the Department Of Justice also launch a criminal investigation, and also files charges for civil rights violations, arrest him, charge him, federally prosecute him, and convict him as well. A message need to be sent to all rogue police officers who break the law, will be arrested, charged, prosecuted to the full extent of the law, and convicted.
