Former New Rochelle High School Teacher Designated Level 2 Sex Offender by Judge

WHITE PLAINS, NY — John Fraioli, released after serving most of a six-month sentence in the Westchester County Jail, was back in Westchester County Court on June 10. Judge Susan Cacace completed his sentencing with a risk level designation of Level 2 Sex Offender (moderate risk). Fraioli is scheduled to remain under Post Release Supervision until Jan. 26, 2031.

Fraioli, aged 36 of White Plains, pleaded guilty on October 13, 2020, before Westchester County Court Judge Susan Cacace to sexually abusing a child victim on more than one occasion during 2019. The child victim was a student at New Rochelle High School, where Fraioli had been employed as a teacher.

As part of his plea agreement, Fraioli admitted under oath that he committed Criminal Sexual Act in the Third Degree on the New Rochelle charge, and to one count of Rape in the 3rd Degree on the White Plains charge, both class E felonies.

Under the terms of the plea, he agreed to a sentence of 10 years’ sex offender probation, with shock probation, which meant six months in the county jail followed by 9.5 years’ sex offender probation. He surrendered his New York State teaching license and agreed to register as a sex offender.

He was sentenced on January 26, 2021.

Fraioli was initially arrested by New Rochelle Police after he engaged in a sexual act with the victim in the school building in May 2019. Fraioli resigned from his teaching position before his arrest. Later, he continued to abuse the victim in his White Plains home. White Plains Police made the arrest in November.

Sex offender probation involves a term of 10 years of supervision by the department of probation sex offense unit, with a set of guidelines that include among other things, mandatory participation in treatment, restrictions on daily living, travel, use of computers, employment and living conditions, regular submission to polygraph tests to monitor compliance and historical offending behavior, and regular supervision by the court to ensure compliance. It is also revocable at any indication of non-compliance.

Fraioli is now listed in the Department of Criminal Justice Services New York State Sex Offender Registry. He is listed as living in White Plains. He is under the supervision of the Westchester County Department of Probation.
