New Rochelle Man Charged With Third-Degree Burglary, Released Without Bail

Written By: Robert Cox

NEW ROCHELLE, NY (October 13, 2026) — A 40-year-old man arrested by New Rochelle police on a felony burglary charge in August was released on his own recognizance following a weekend arraignment, according to records maintained by the New York State Unified Court System.

Travis Nelson, born in 1986, was arrested August 21, 2026, and charged with burglary in the third degree, a Class D felony under New York Penal Law § 140.20.

Nelson was arraigned August 22 before Rye City Court Judge Valerie A. Livingston, who was presiding over a weekend arraignment involving a New Rochelle City Court case. Livingston issued a temporary order of protection and released Nelson on his own recognizance, meaning he was not required to post monetary bail.

The arraignment occurred on a Saturday, when Westchester County operates a centralized weekend arraignment system. Judges from different city courts may preside over cases originating in other municipalities as part of that arrangement.

Under New York law, third-degree burglary involves knowingly entering or remaining unlawfully in a building with the intent to commit a crime inside. A conviction carries a maximum prison sentence of seven years.

Third-degree burglary is generally not a bail-qualifying offense under New York’s criminal justice laws unless additional statutory circumstances apply. Judges ordinarily must release defendants charged solely with nonqualifying offenses on their own recognizance or impose nonmonetary conditions.

The available court records do not identify the location of the alleged burglary, the circumstances of Nelson’s arrest, whether property was stolen or damaged, or whether anyone was threatened or injured.

Court records show that Nelson’s case was subsequently adjourned September 3 before Judge Jared R. Rice and again September 21 before Rice.

Nelson’s next scheduled appearance is October 19, 2026, at 9:30 a.m. in New Rochelle City Court.

The case is docketed as CR-03979-26. The New Rochelle Police Department arrest number is 20260068714.

Nelson is represented by the Legal Aid Society of Westchester County. The case is being prosecuted by the Westchester County District Attorney’s Office.

Talk of the Sound has contacted the New Rochelle Police Department’s Public Information Office seeking additional information about the alleged burglary, including the location, circumstances of the incident and whether anyone was injured or property was stolen. A Freedom of Information Law request has also been submitted for police reports and related records.

The Westchester County District Attorney’s Office has also been contacted regarding the status of the prosecution and any additional information not contained in police records.

The charge is an allegation. Nelson is presumed innocent unless and until proven guilty.
