NEW ROCHELLE, NY (October 28, 2026) — A 44-year-old New Rochelle woman who spent more than two months in the Westchester County Jail following her arrest on first-degree robbery charges has pleaded guilty to misdemeanor assault and been released from custody, according to updated New York State court records and a correctional notification.

Holly Rios, arrested August 22 by New Rochelle police, pleaded guilty to third-degree assault, a Class A misdemeanor, and was sentenced to time served. A notification issued Wednesday by the New York Sheriffs’ VINE Service confirmed that Rios was released from custody October 28.

The updated court record shows that an attempted second-degree assault charge, a Class E felony, was reduced to third-degree assault. Rios pleaded not guilty to the attempted assault charge before entering a guilty plea to the misdemeanor.

The court imposed a $175 mandatory surcharge and a $25 crime victim assistance fee, both due December 28, 2026. The sentencing entry also references an order of protection.

Rios was originally charged with two counts of first-degree robbery, both Class B felonies, and one count of attempted second-degree assault following an August 22 incident. She was arraigned August 23 before New Rochelle City Court Judge Alexandra R. Bisesi, who set bail at $10,000 cash, a $20,000 insured bond or a $30,000 partially secured surety bond.

Rios was booked into the Westchester County Department of Correction in Valhalla on August 23 at 3:08 p.m. She remained incarcerated for approximately 66 days before her release Wednesday.

As previously reported by Talk of the Sound on October 15, Rios remained jailed despite bail having been set. At that time, court records listed a November 4 appearance associated with a Superior Court Information, a charging document used in felony prosecutions.

The latest court notification instead listed an October 28 appearance before New Rochelle City Court Judge Michelle Bernstein. The updated docket records the misdemeanor guilty plea and time-served sentence.

The two first-degree robbery charges previously listed in court records do not appear in the latest case update. The available records do not explain whether those charges were dismissed, withdrawn or otherwise resolved as part of the disposition.

The publicly available court records also do not identify the alleged victim or victims or describe the circumstances of the August incident.

The case is docketed in New Rochelle City Court under CR-03987-26.
