With Charges Reduced from Felony Child Rape to a Violation, New Rochelle Man Walks

NEW ROCHELLE, NY (February 10, 2023) — Yonsin Macario Cordon pleaded guilty today to Harassment – 2nd Degree before Judge Matthew J. Costa in New Rochelle City Court.

Macario Cordon, then 32, of New Rochelle was arrested by New Rochelle Police and charged with Rape in the Third Degree on July 31, 2020. Yonsin was arraigned in New Rochelle City Court on that day. Bail was set at $250,000 cash or bond.

The arrest came after a month long investigation by New Rochelle Police Detectives after a report was made of a possible sexual assault at a private residence on Ashland Street on July 3rd, 2020 at 10:35 p.m.

Rape in the Third Degree is charged when a person engaged in sexual intercourse with someone who is incapable of consent either due to age or intoxication. If an individual is at least 21 years old and has sex with a person younger than 17 that person has committed Rape in the Third Degree.

Rape Third Degree known commonly as Statutory Rape is a non-violent E felony punishable by up to one and a third to four years in prison. A conviction also requires registering as a sex offender.

The charge against Macario Cordon was reduced to Sexual Misconduct, a class A misdemeanor, then reduced again today prior to Macario Cordon entering a guilty plea.

Harassment in the second degree is a violation.

He was sentenced to a one-year conditional discharge. a 2-year permanent order of protection and $370 in fines and fees.

Macario Cordon is not required to register as a sex offender.
