ALBANY, NY (April 1, 2026) — The New York State Public Service Commission denied a request by Sustainable Westchester for an extension to file its 2025 Community Choice Aggregation annual report, finding the request was not submitted by the required deadline and directing the organization to file as soon as possible, but no later than April 7, 2026.
In a letter dated April 1, 2026, Secretary to the Commission Michelle L. Phillips wrote that the filing had been due March 31, 2026, and that Sustainable Westchester’s request for an extension until April 10, 2026, was untimely under the governing order.
“Ordering Clause 10 of the Order referenced in your extension request (Case 14-M-0224, Order Authorizing Framework for Community Choice Aggregation Opt-Out Program (issued April 21, 2016) aka ‘CCA Framework Order’) required any extension request that is submitted to the Secretary to be filed at least one day prior to the affected deadline,” Phillips wrote.
Phillips stated that because the request was not submitted in advance of the deadline, it could not be granted. “Your request is untimely,” she wrote. “As a result, Sustainable Westchester should endeavor to file its report as soon as possible, which will be on or before April 7, 2026.”
The ruling will be posted on the Department’s website, according to the letter.
Sustainable Westchester, in a March 31, 2026 letter signed by Director of Clean Power Dan Welsh, had requested the extension to April 10 in order “to finish compiling reporting elements from various sources.” The request cited requirements under the CCA Framework Order that annual reports be filed by March 31 each year for the prior performance year.
The correspondence was filed under Matter 17-00974, “In the Matter of Financial Reports for Community Choice Aggregation Programs.”
