NEW ROCHELLE, N.Y. (Aug. 31, 2026) — Sunny Hostin’s effort to get a trespassing charge against her son dismissed outright prolonged the case for weeks after Westchester County prosecutors repeatedly offered him a diversion program that ultimately led to the dismissal now being sought from the court, according to a new account provided directly to Talk of the Sound by the Westchester County District Attorney’s Office.
Gabriel Hostin, son of “The View” co-host and former federal prosecutor Sunny Hostin, was cited by MTA Police on June 16 after officers found him on the Metro-North Railroad right-of-way near the New Rochelle train station, in a posted no-trespassing area close to an electrified third rail.
He was issued a violation under Penal Law § 140.05 and released.
Sunny Hostin then became personally involved in seeking dismissal of the case, writing to Westchester Assistant District Attorney Amanda Greene and arguing that her son had made an “honest mistake” and posed no threat to the community.
What was not publicly known at the time was that prosecutors and the defense were already at odds over how the case should be resolved.
Anna Young, director of communications and public affairs for Westchester County District Attorney Susan Cacace, told Talk of the Sound that prosecutors repeatedly offered Gabriel Hostin participation in Fresh Start, the office’s pre-arraignment diversion program for eligible first-time, low-level offenders.
“The defendant’s attorney at the time declined our Fresh Start offer, instead insisting that the case be resolved with an immediate dismissal, a position that resulted in multiple court adjournments by the defendant,” Young said.
The District Attorney’s Office kept the offer open.
“Our office continued to make Fresh Start available, which the defendant’s new attorney, Teny Geragos, promptly accepted on her client’s behalf,” Young said.
Gabriel Hostin completed Fresh Start on Aug. 20.
“A letter requesting dismissal of the charges has been sent to the court,” Young said. “There will be no further court appearances.”
The result is that Hostin’s case is now headed for dismissal, but through the diversion program prosecutors had been offering rather than through the immediate, unconditional dismissal initially sought by the defense.

Fresh Start was the first option identified.
Talk of the Sound reported that the program was designed for eligible first-time, low-level offenders, including people accused of trespassing, and that successful completion could result in the District Attorney’s Office declining to prosecute.
The Aug. 12 report also drew a distinction between those three alternatives and what Sunny Hostin was seeking.
“None of the three options is the same as what Sunny Hostin has sought: a motion asking a judge to dismiss the charge outright,” Talk of the Sound reported at the time.

Participants who fail to complete the program or are rearrested must appear in court.
Gabriel Hostin completed the program Aug. 20, and prosecutors then sent a letter to New Rochelle City Court requesting dismissal of the trespassing charge.
June Encounter on Metro-North Tracks
MTA Police encountered Gabriel Hostin on June 16 after officers observed him on railroad property near the New Rochelle station.
The MTA later said officers with a train patrol team saw him running along the railroad right-of-way close to an electrified third rail after officers exited a train at New Rochelle.
He was stopped near Commerce Drive at about 8 p.m. and detained while officers conducted a criminal-history check and removed him from the track area.
Body-worn camera footage showed Sunny Hostin speaking to her son by telephone during the encounter.
She identified herself to officers as a co-host of “The View” and a former federal prosecutor and asked that Gabriel Hostin be allowed to leave with a warning rather than receive a citation.
An officer told her he could not do that “at this point.”
Police issued Gabriel Hostin a summons for trespass and released him.
Sunny Hostin later continued her effort to have the matter dismissed by contacting the prosecutor handling the case.
