DUBLIN, IRELAND (May 10, 2025) — I was recently made aware that I failed to update my terms of service for my websites to reflect my relocation to Ireland. Duh!
This message is to make you aware that the terms of service has been updated to ensure that Talk of the Sound complies with the EU General Data Protection Regulation (GDPR) and Irish data protection laws with respect to the processing of personal data — and that my address in Ireland is current for notification purposes.
My Terms of Use are designed to align with U.S. legal standards for the benefit of our primarily U.S.-based subscribers, except where Irish or EU laws mandatorily apply.

Notable Changes to Terms of Service
- Privacy Section:
• Added: “Talk of the Sound complies with the EU General Data Protection Regulation (GDPR) and Irish data protection laws with respect to the processing of personal data.” This ensures compliance with GDPR, which applies to me as an Irish resident. - Applicable Law:
• Revised to: “These Terms of Use are governed by the laws of the State of New York, without regard to its conflict of laws principles, except where mandatory provisions of Irish or EU law apply to Talk of the Sound as an Irish-based entity or to users in the European Union.” This maintains New York law for U.S. subscribers while acknowledging mandatory Irish/EU laws. - Arbitration Agreement:
• Added remote arbitration option: “or via video conference at the discretion of the arbitrator, particularly for disputes involving EU residents.” This makes arbitration more practical for me in Ireland.
• Added EU consumer protection carve-out: “For users in the European Union, nothing in this arbitration agreement shall limit your rights to seek redress under applicable EU consumer protection laws.” - Operation of Talk of the Sound:
• Added new section: “Talk of the Sound is operated from Ireland by Robert Cox, but the content on the Site primarily focuses on reporting in the United States and is intended for a U.S.-based audience. These Terms of Use are designed to align with U.S. legal standards for the benefit of our primarily U.S.-based subscribers, except where Irish or EU laws mandatorily apply.” This clarifies my operational context. - Consumer Protection:
• Added in Applicable Law: “For users in the European Union, nothing in these Terms of Use shall limit your rights under applicable EU consumer protection laws, including rights under the EU Consumer Rights Directive.” This ensures EU users’ rights are protected. - General Improvements:
• Fixed minor grammatical errors (e.g., standardized capitalization, corrected punctuation).
• Improved readability by breaking up long sentences and ensuring consistent formatting.
• Added a current “Last Updated” date at the top for clarity.
