WHITE PLAINS, NY (September 15, 2022) — Daniel Flores Arteaga, 28, of New Rochelle, was sentenced today to 17 years in New York State Prison by Associate Supreme Court Justice James McCarty in Westchester Criminal Court.
Under a plea agreement entered into on July 14, 2022 before Judge McCarty, Flores Arteaga pleaded guilty to Manslaughter – 1st, a felony, and was sentenced to 17 years in prison and 5 years of supervised release.
His father filed a victim impact statement as part of the Pre-Sentencing Report but, according to the prosecutor, Special Prosecutions Assistant District Attorney Wendy Parra, Chief of the Domestic Violence Bureau, he did not wish to appear in court at sentencing.
Flores Arteaga addressed the court before sentencing.
“I loved my mother very much. I did not anything to happen”, he said.
He made reference to his own mental illness which Judge McCarty acknowledged played a role, but, McCarty noted, not to the extent it was not made part of his defense.
After he was remanded, Flores Arteaga nodded towards two people, a man and a woman, seated in the gallery.
Police investigation:
On March 17, 2020, at approximately 1:30 p.m., New Rochelle Police responded to a residence on Second Street in New Rochelle on a call of a son attacking his mother. Police found Daniel Flores Arteaga at the scene and his mother unconscious on the floor.
Flores Arteaga subsequently told police that he had strangled his mother at about 1:00 pm.
Police rushed the mother to Montefiore New Rochelle Hospital where she was placed on life support.
Flores Arteaga was arrested by New Rochelle Police on March 17, 2020.
Court proceedings:
Arteaga was arraigned on March 18th for attempting to kill his elderly mother. Flores Arteaga appeared in Westchester County Court and was charged with Attempted Murder in the Second Degree, a class B violent felony.
Bail was set at $250,000 cash, $2.5 million bond or $2.4 million partially secured bond alternative with a requirement of 10% down. His next court appearance was scheduled for April 1, 2020.
On March 26, 2020, she was removed from life support and pronounced deceased.
Flores Arteaga was arraigned on on April 1 on an elevated charge of Murder in the Second Degree, a class A violent felony, for strangling his mother who died in the hospital.
Bail remained set at $250,000 cash, $2.5 million bond or $2.4 million partially secured bond alternative with a requirement of 10% down.
Flores Arteaga did not post bail and has been houses at the Westchester County Jail since his arrest.
